A primer on the risks of foreign investment

Dentons’ partners Rachel A. Howie, James Langley and John J. Hay were featured in an episode of The Northern Miner Podcast where they discussed the risks investors and companies face when operating in another country.

The panel was moderated by Canadian Mining Journal Editor-in-chief Tamer Elbokl, with information on the importance of learning trade agreements beforehand and how lawyers can help improve legal protection for companies and investors.

James Langley

About James Langley

James trained with the Firm and qualified as a lawyer in the Dispute Resolution practice in 2008. As a Partner with Higher Rights of Audience, James focuses on international arbitration, including both commercial arbitration and investor state arbitration, as well as commercial litigation and alternative dispute resolution. He has experience of arbitration and litigation predominantly within the energy and infrastructure, retail, telecoms, shipping and sports sectors, including proceedings under the ICSID, ICC, LCIA, DIFC-LCIA, UNCITRAL, LMAA and ADCCAC (Abu Dhabi) arbitration rules. James has most recently worked for: a South Asian state defending a claim by a UAE entity under the UNCITRAL Rules relating to an alumina refining project; a multinational energy company in an arbitration under the ICC Rules relating to a dispute concerning completion under an SPA; and a South Asian state pursuing and defending claims in the English courts relating to challenges/appeals to arbitral awards worth several billion dollars. James has benefited from secondments based in Moscow and Dubai during his time at the Firm.

About John J. Hay

John Hay is a partner in Dentons’ New York Office and the head of the US International Dispute Resolution group. John has more than 35 years’ experience representing domestic and international clients in complex commercial and investment treaty disputes. His practice involves matters in federal and state courts throughout the US and before arbitration tribunals throughout the world, including the International Centre for Settlement of Investment Disputes (ICSID), the London Court of International Arbitration (LCIA), the International Centre for Dispute Resolution (ICDR) of the American Arbitration Association (AAA), and the International Chamber of Commerce (ICC).
